These Terms of Service ("Terms") govern your access to and use of Casty ("Casty", "we", "us") mobile apps, websites, and related services (the "Services"). By creating an account or using the Services, you agree to these Terms.
1. Eligibility
You must be at least 16 years old and able to form a binding contract. If you use the Services on behalf of a company or production, you represent that you have authority to bind that organization.
2. Accounts
- You are responsible for your account credentials and all activity under your account.
- Provide accurate profile information and keep it up to date.
- Notify us promptly at support@statyst.app if you suspect unauthorized access.
- You may delete your account at any time from in-app Settings.
3. The Services
Casty helps talent build portfolios, discover casting opportunities, apply to roles, and complete on-set attendance flows. Directors and productions use the Services to manage casting operations. Features may change; we may suspend or discontinue parts of the Services with reasonable notice where practicable.
4. Your content
You retain ownership of photos, text, and other content you upload ("User Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute User Content solely to operate and promote the Services (including your public portfolio if you enable it). You represent that you have all rights needed for User Content and that it does not violate law or third-party rights.
5. Acceptable use
- Do not harass, discriminate against, or endanger others.
- Do not upload unlawful, misleading, or sexually exploitative content involving minors.
- Do not scrape, reverse engineer, or interfere with the Services.
- Do not impersonate others or misrepresent your identity or qualifications.
- Do not use the Services for spam or unauthorized commercial solicitation.
6. Casting and third parties
Casting opportunities may be offered by third-party productions. Casty is not the employer of talent unless explicitly stated in a separate agreement. Any engagement, payment, or working conditions are between you and the production. We are not responsible for third-party conduct.
7. Casting participation
When you apply to a role or use check-in/check-out on a casting day, you agree to provide accurate information, attend as committed, follow production safety rules, and use attendance features only for yourself.
8. Payments
If paid features or in-app purchases are offered, prices and billing are shown at purchase and processed by the applicable app store.
9. Intellectual property
The Services, including software, branding, and design, are owned by us or our licensors. Except for the limited rights in these Terms, no license is granted.
10. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE CASTING BOOKINGS, INCOME, OR AVAILABILITY OF ANY ROLE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) EUR 100, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.
12. Indemnity
You will defend and indemnify us against claims arising from your User Content, your use of the Services, or your violation of these Terms or applicable law.
13. Termination
You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms or if necessary to protect the Services or others. Sections that by nature should survive will survive termination.
14. Governing law and disputes
These Terms are governed by the laws of Poland, without regard to conflict-of-law rules, except where mandatory consumer protections in your country of residence apply. Courts in Warsaw, Poland have exclusive jurisdiction for business users; consumers may bring claims in their home jurisdiction where required by law.
